Ember Terms & Conditions
Effective 1 November 2026.
1. Who we are
Ember is made by Spawns Gaming LLC ("Spawns Gaming", "we"), a solo independent developer. Contact: support@spawnsgaming.com. By installing Ember or buying the Ember plan, you agree to these terms.
2. The Ember app
The app is free. We grant you a personal, non-transferable licence to install and use it on computers you own or control. You may not sell or redistribute modified copies, or try to bypass its licence checks or its safety checks (such as its code-integrity check and Approve cards).
3. The Ember plan
The Ember plan is a monthly subscription that includes AI usage for Ember, provided through our server and Anthropic's Claude models.
Each billing month includes an AI allowance (currently $6.00 of usage, about 1,200 typical replies). Unused allowance does not carry over.
Top-ups add AI credit that is used after the monthly allowance and doesn't expire while your plan is active.
The plan works only with the Ember app. Requests that don't come from Ember, or that exceed reasonable limits (for example, more than 40 requests a minute), may be refused.
When the allowance and credit run out, Ember tells you, and you can add a top-up or wait for the next month.
4. Payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's Buyer Terms apply to your purchase. Prices are in US dollars, and Paddle adds sales tax or VAT where it applies. We'll give at least 30 days' notice by email before any price change applies to your subscription.
5. Cancelling and refunds
You can cancel at any time from the link in your receipt email or through Paddle. The plan stays active until the end of the period you've paid for. Refunds are covered by our Refund Policy.
6. Acceptable use
You must be at least 18 years old, or the age of majority where you live. You agree not to use Ember or the Ember plan:
to break the law or harm others;
in ways that breach Anthropic's Usage Policy, which applies to everything sent to Claude through the Ember plan;
as a general AI service, or to resell or share access to it;
to attack, overload or probe our server.
We may suspend or end a licence that breaks these rules.
7. What Ember does on your PC
Ember can open apps, read and write files you allow, and act in other programs. Anything that changes or sends something asks for your approval first, except where you choose otherwise in its settings. You're responsible for what you approve. Ember can make mistakes, and AI answers can be wrong. Don't rely on it for medical, legal, financial or safety-critical decisions. Ember never completes purchases for you: when it fills a shopping cart, you check it and place the order yourself.
8. Your data
How we handle information is described in our Privacy Policy.
9. Other services
The Ember plan relies on Anthropic (the AI), Cloudflare (our server) and Paddle (payments). Their outages can affect Ember. We're not responsible for third-party websites, stores, games or apps that Ember works with.
10. Changes to Ember
We improve Ember through signed updates and may change, add or remove features. If a change removes the main purpose of a plan you've paid for, you may ask for a refund of the unused part of that period.
11. No warranty
Ember is provided "as is" and "as available", to the extent the law allows. We don't promise it will be uninterrupted or error-free.
12. Limit of liability
To the extent the law allows, Spawns Gaming's total liability for any claim about Ember is limited to the amount you paid us in the 12 months before the claim. We're not liable for indirect or consequential losses, or for lost data, profits or opportunities. Nothing in these terms limits rights you have under consumer law that can't be excluded.
13. Ending
You can stop using Ember at any time. We may end your access if you seriously or repeatedly break these terms. Sections 11 to 14 continue after the agreement ends.
14. Law
These terms are governed by the laws of the State of New York, USA, and disputes go to the courts located in New York, unless your local consumer law gives you the right to use your own courts.
15. Changes to these terms
If we change these terms in a meaningful way, we'll post the new version here with its effective date and tell subscribers by email at least 14 days before it applies.
